Copyright Policy

Our Policy

Trakx respects the intellectual property rights of others and expects our users to do the same. It is our policy to respond to clear notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act ("DMCA") and other applicable copyright laws.

If you believe that content available on Trakx infringes your copyright, you (or your agent) may submit a takedown notice using the process below.

Designated Agent

In accordance with the DMCA, Trakx has designated an agent to receive notifications of claimed copyright infringement. Our designated agent is registered with the U.S. Copyright Office's DMCA Designated Agent Directory.

Filing a Takedown Notice

To file a notice of alleged copyright infringement, send a written communication to our designated agent that includes substantially all of the following:

1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
2. Identification of the copyrighted work claimed to have been infringed (or a representative list, if multiple works are covered by a single notice).
3. Identification of the material you claim is infringing, and information reasonably sufficient to let us locate it — e.g. a link to the video, the username of the poster, or the track name.
4. Your contact information — name, mailing address, phone number, and email address.
5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Notices that do not substantially comply with these requirements may not receive a response.

What Happens Next

Upon receiving a valid notice, we will act expeditiously to remove or disable access to the reported content, and will make a reasonable effort to notify the user who posted it.

Users who repeatedly infringe the copyrights of others will have their accounts suspended or terminated, in accordance with our repeat infringer policy below.

Counter-Notification

If you believe content you posted was removed or disabled by mistake or misidentification, you may submit a counter-notification to our designated agent. Your counter-notification must include:

1. Your physical or electronic signature.
2. Identification of the material that was removed and the location where it appeared before removal.
3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
4. Your name, address, phone number, and a statement that you consent to the jurisdiction of the federal court in your district (or, if outside the U.S., any judicial district in which Trakx may be found), and that you will accept service of process from the person who filed the original notice or their agent.

Upon receipt of a valid counter-notification, we may reinstate the removed content in accordance with the DMCA's timeline, unless the original complainant files a court action seeking to restrain the user from engaging in infringing activity.

Repeat Infringer Policy

Trakx maintains a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. Each valid takedown notice actioned against a user's content is recorded against their account. Accounts that accumulate multiple valid strikes are subject to suspension or permanent termination at our discretion.

Fingerprint Data

Trakx uses audio fingerprinting (ShazamKit and a proprietary constellation-hashing service) to identify tracks played in user-uploaded videos, including unreleased tracks. A fingerprint is a one-way numeric representation of an audio clip — it cannot be used to reconstruct or play back the underlying audio, and no copyrighted audio files are stored on our servers as part of this feature. Fingerprinting is used solely to power in-app track identification and is not a claim of ownership over any music.

False Claims

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be liable for damages. Please do not submit false or bad-faith claims.
